These Terms of Use (“Terms”) govern your access to and use of the Gonzalez Car Rentals website, online booking services, and related services provided by Gonzalez Car Rentals (“Gonzalez Car Rentals,” “we,” “us,” or “our”), a locally operated vehicle rental business serving Boston, Greater Boston, the South Shore, and surrounding Massachusetts communities.

By accessing this website, submitting a reservation request, or using our services, you agree to these Terms. A vehicle rental is also governed by a separate written Rental Agreement provided at or before the start of the rental. If there is a conflict between these website Terms and an executed Rental Agreement, the Rental Agreement will govern the rental transaction to the extent permitted by applicable law.

Vehicle Rentals

All rentals are subject to vehicle availability, renter eligibility, identity verification, and approval by Gonzalez Car Rentals.

Rental rates, rental periods, mileage allowances, deposits or payment authorizations, insurance or coverage requirements, additional-driver requirements, and other applicable conditions will be disclosed before or as part of the rental transaction.

Renters and authorized drivers must possess a valid driver's license and satisfy any lawful eligibility requirements established by Gonzalez Car Rentals.

Only individuals specifically authorized under the Rental Agreement may operate the rented vehicle.

Rental Agreement

Every confirmed rental is subject to a written Rental Agreement identifying the vehicle, authorized driver or drivers, rental period, charges, permitted use, and other applicable conditions.

For rental transactions governed by Massachusetts laws concerning private passenger vehicle rentals, Gonzalez Car Rentals will provide disclosures and notices required by applicable Massachusetts law.

The renter should carefully review the Rental Agreement before signing or accepting possession of the vehicle.

Pricing, Taxes, Fees, and Surcharges

Rental pricing will be disclosed before confirmation or stated in the Rental Agreement.

Applicable taxes, government-imposed surcharges, tolls, delivery charges, additional-driver charges, late-return charges, mileage charges, cleaning charges, refueling charges, or other lawful fees may apply depending on the rental.

Where Massachusetts law requires a surcharge, fee, or charge to be separately stated, Gonzalez Car Rentals will identify that charge separately in the Rental Agreement.

Any advertised rental rate may be subject to applicable taxes, government-imposed surcharges, and clearly disclosed additional charges.

Insurance and Optional Coverage

Renters must satisfy the insurance or financial-responsibility requirements applicable to their rental.

A renter's personal automobile insurance, credit-card benefits, or other insurance may provide coverage for a rental vehicle. Renters are encouraged to verify their individual coverage directly with their insurer or coverage provider before renting.

Where Gonzalez Car Rentals lawfully offers optional insurance products, protection products, or a Collision Damage Waiver, such products will be separately disclosed and offered in accordance with applicable Massachusetts law.

The purchase of an optional Collision Damage Waiver or other optional coverage will not be represented as mandatory when Massachusetts law requires that the coverage remain optional.

Gonzalez Car Rentals does not guarantee that a renter's personal insurance policy, credit-card coverage, or other third-party coverage will apply to any particular rental or loss.

Collision Damage Waiver

If Gonzalez Car Rentals offers a Collision Damage Waiver for a rental subject to Massachusetts General Laws Chapter 90, Section 32E½, the Collision Damage Waiver will be offered and documented in accordance with Massachusetts law, including required notices and renter authorization.

Any applicable Collision Damage Waiver terms, exclusions, price, and required statutory disclosures will be contained in the Rental Agreement or associated coverage documentation.

Deposits and Payment Authorizations

Depending on the rental, Gonzalez Car Rentals may require an advance payment, reservation payment, security authorization, or other deposit where permitted by applicable law.

The amount, purpose, conditions, and applicable refund terms will be disclosed before or during the rental transaction.

For rentals subject to Massachusetts General Laws Chapter 90, Section 32E½, Gonzalez Car Rentals will not require a renter who declines a Collision Damage Waiver to provide a cash or credit-card deposit for the purpose of covering possible damage or loss to the rental vehicle where prohibited by Massachusetts law.

Amounts lawfully owed under the Rental Agreement may include unpaid rental charges, tolls, tickets, fuel charges, excess mileage, late-return charges, excessive cleaning charges, or other properly disclosed amounts.

Any remaining refundable amount will be returned or released in accordance with the Rental Agreement, payment-processor timelines, and applicable law.

Damage, Loss, and Vehicle Condition

The renter is responsible for complying with the damage and loss provisions contained in the Rental Agreement to the extent permitted by applicable law.

Vehicles may be inspected and documented before and after each rental. Renters should report any existing damage before accepting the vehicle and immediately report accidents, theft, vandalism, mechanical issues, or newly occurring damage during the rental period.

Nothing in these Terms is intended to impose liability upon a renter where such liability is prohibited or limited by Massachusetts law or applicable insurance coverage.

Tickets, Tolls, Parking, and Violations

The renter is responsible for tolls, parking charges, traffic citations, towing charges, impound charges, and other violations arising from the renter's or an authorized driver's use of the vehicle during the rental period, to the extent permitted by law.

Gonzalez Car Rentals may charge the renter for such amounts and any separately disclosed, lawful administrative fees associated with processing them.

Fuel, Mileage, and Vehicle Return

Fuel requirements, mileage allowances, geographic restrictions, return location, and required return time will be stated in the Rental Agreement.

Additional charges may apply for excess mileage, missing fuel, unauthorized extensions, failure to return the vehicle as agreed, or other violations of the Rental Agreement where permitted by law and properly disclosed.

A renter seeking to extend a rental must receive approval from Gonzalez Car Rentals before the original rental period expires.

Prohibited Uses

Unless expressly authorized in writing by Gonzalez Car Rentals and permitted by law, vehicles may not be:

Operated by an unauthorized or unlicensed driver;

Used for any illegal purpose;

Used while the driver is impaired by alcohol, illegal drugs, or other substances that make operation unlawful;

Used for racing, speed contests, driver training, or similar activities;

Used to push or tow another vehicle, trailer, or object;

Subleased, rented, or transferred to another person;

Used outside any geographic limitations contained in the Rental Agreement;

Intentionally, recklessly, or willfully damaged or misused; or

Used to transport persons or property for compensation unless that use is specifically authorized by Gonzalez Car Rentals and permitted under the applicable Rental Agreement and insurance coverage.

Smoking or vaping may also be prohibited in Gonzalez Car Rentals vehicles as stated in the Rental Agreement. Lawfully disclosed cleaning or remediation charges may apply for violations.

Rideshare and Delivery Use

Use of a Gonzalez Car Rentals vehicle for rideshare, delivery, transportation-network-company, courier, or other commercial activity is permitted only when expressly approved in writing by Gonzalez Car Rentals and when appropriate insurance or other required coverage is in effect.

A renter may not assume that a vehicle is authorized for Uber, Lyft, DoorDash, Instacart, or any similar service unless specifically approved.

Accidents and Emergencies

Any accident, theft, vandalism, or material vehicle damage must be reported to Gonzalez Car Rentals as soon as reasonably possible.

Renters must comply with applicable Massachusetts accident-reporting laws, cooperate with law enforcement when required, and provide Gonzalez Car Rentals and applicable insurers with reasonably requested information regarding the incident.

Emergency situations involving injuries or immediate danger should be reported to emergency services first.

Maintenance and Mechanical Issues

Gonzalez Car Rentals maintains its vehicles with the goal of providing safe and dependable transportation.

If a warning light, mechanical problem, tire issue, or other potential safety problem occurs during the rental, the renter should stop operating the vehicle when continued operation could be unsafe and contact Gonzalez Car Rentals promptly.

Renters may not authorize repairs, parts replacement, towing, or other substantial vehicle expenses without approval from Gonzalez Car Rentals except where necessary to address an immediate emergency.

Reservations and Cancellations

Submitting a reservation request does not guarantee vehicle availability until the reservation has been accepted or otherwise confirmed by Gonzalez Car Rentals.

Cancellation, rescheduling, no-show, and refund policies applicable to a particular reservation will be disclosed during the booking process or in the Rental Agreement.

Website Information

We attempt to keep vehicle descriptions, availability, prices, photographs, and other website information accurate and current. However, availability and fleet composition may change.

A specific vehicle, trim level, feature, or configuration is not guaranteed unless expressly confirmed in writing.

Website Use

You may not use this website to engage in fraud, submit false information, attempt unauthorized access, interfere with website functionality, scrape or misuse proprietary information, or conduct unlawful activity.

We may restrict website access or decline a reservation request where reasonably necessary to prevent fraud, protect our vehicles, enforce these Terms, or comply with applicable law.

Intellectual Property

Unless otherwise stated, the Gonzalez Car Rentals name, branding, website content, photographs, graphics, and other original materials are owned by or licensed to Gonzalez Car Rentals and may not be copied, reproduced, distributed, or commercially used without authorization.

Limitation of Liability

To the fullest extent permitted by applicable law, Gonzalez Car Rentals will not be responsible for indirect, incidental, special, or consequential damages arising solely from the use or inability to use this website.

Nothing in these Terms excludes, waives, or limits any responsibility or consumer right that cannot legally be excluded, waived, or limited under Massachusetts or federal law.

Vehicle-related liability, insurance obligations, physical damage responsibility, and claims arising from a rental are governed by the applicable Rental Agreement, applicable insurance coverage, and governing law.

No Waiver of Consumer Rights

Nothing contained in these Terms or any Gonzalez Car Rentals policy is intended to waive rights or protections that a consumer is entitled to under applicable Massachusetts or federal law.

If any provision of these Terms conflicts with a non-waivable requirement of applicable law, that legal requirement will control.

Privacy

Information submitted through our website or booking process may be used to process reservations, verify renter eligibility, communicate with customers, prevent fraud, administer rentals, collect amounts lawfully due, and operate our business.

Changes to These Terms

Gonzalez Car Rentals may update these Terms periodically to reflect changes to our services, policies, or applicable law.

The version applicable to a rental transaction will be the version in effect when the reservation or applicable Rental Agreement is entered into, unless otherwise required by law.

Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts, without giving effect to conflict-of-law principles, except where federal law or another applicable law controls.
